Psychological Examination

The Court may order the parties in a disputed child custody case to submit to a psychological examination. Usually the Judge appoints a mental health expert to conduct the examination and the parties are responsible for 50% of the cost of the evaluation. However, this is not always the case and we will need to discuss the matter with each client individually. The cost averages between $5,000.00 and $8,000.00. The evaluator will evaluate the parties and the children and make a recommendation to the Court as to which parent should have primary conservatorship of the children. The evaluator can also request additional testing (such as drug tests) and information to verify information received in the course of the testing and interviews.

Mediation

Mediation is a process used to facilitate the settlement of claims between the parties. In divorce cases, that includes division of property and provisions regarding custody, visitation and support of the children. Each party, along with their attorney, communicates through a neutral, third-party mediator. The process is confidential. The parties can either agree to a mediator or the Court may appoint someone. Normally, the cost of the mediator is shared between the parties equally but the burden can be shifted in certain circumstances. Mediators charge varying rates which can depend upon the amount of time needed for the mediation.
